Mike Sexton Depends Poker in South Carolina
Mike Sexton of World Poker Tour fame took to the stands at a South Carolina court room to defend the game of poker in the United States and to assist in the case where 5 people are accused of running illegal poker games. His expert testimony was used by the defence to argue that poker wasn't solely gambling but more a game of skill. It was hoped that this line of defence may lessen any setence handed down, but it was widely thought any decision would have little or no impact on the US or South Carolina gaming laws, where all gambling remains banned. However, in a shock move, the judge recognised poker as a skilled-based game, keeping the door to a wider legalisation of poker (possibly all gambling) ajar, even if only slightly.
This case comes off the back of the dismisal of the Kentucky state trial against some of gaming's biggest websites for accepting US players. Initially, the Commonwealth of Kentucky wanted to seize the web domains of operators, something that would have been exceptionally hard to do given most are based outside of the USA - plus any seizure would have set a precedent for the wider online world. The ramifications of which would have been enormous, with countries demanding domains for any perceived slight to local law. It was doomed to failure, but instead of being the nail in gaming's coffin in the US, it may well be viewed as a victory for online poker...
